Terms of Use for Uncle

1. Eligibility

Uncle is intended for users aged 9 years and older.

If you are under 18, you should review these Terms with a parent or legal guardian.

By using the App, you represent that you have the legal capacity to enter into this agreement.

2. Purpose of the App

Uncle is a voluntary screen-time management tool that allows users to:

• Select apps to limit
• Configure usage restrictions
• Receive motivational character interactions when limits are reached

The App relies on Apple’s Screen Time and DeviceActivity frameworks to enforce limits.

Uncle does not collect, store, or transmit app usage data. All relevant activity information remains on your device.

The App is intended for motivational and productivity purposes only and does not provide medical, psychological, or therapeutic advice.

3. Subscriptions & Free Trial

Uncle offers:

• Monthly subscription
• Annual subscription
• 7-day free trial (where applicable)

Payment is processed through Apple’s App Store.

Subscriptions:

• Automatically renew unless canceled at least 24 hours before the end of the current billing period
• Are charged to your Apple ID account
• May be managed or canceled through your Apple ID account settings

If you do not cancel before the free trial ends, your subscription will automatically convert into a paid subscription.

We do not store or access your payment information.

4. Intellectual Property & Limited License

All content within the App — including characters, voice content, scripts, branding, text, graphics, and software — is owned by Uncle and protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

Audio Sharing Permission

Users may share audio clips generated within the App for personal, non-commercial purposes, including sharing with friends or on social media, provided that:

• The content is not modified in a misleading manner
• The content is not used commercially
• The content is not presented as originating from a real person
• The content does not violate applicable laws

All other reproduction, distribution, modification, or commercial exploitation of App content is prohibited without prior written permission.

5. Fictional Characters Disclaimer

All characters, voices, personalities, and interactions within the App are fictional.

Any resemblance to real persons, living or dead, is purely coincidental and unintentional.

The App does not impersonate or represent any real individual, public figure, or organization.

6. User Responsibilities

You agree to:

• Use the App lawfully
• Not misuse shared audio content
• Not attempt to reverse engineer or exploit the App
• Not use the App to harass, defame, or harm others

You are solely responsible for how you configure and use the App.

7. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, express or implied.

We do not guarantee:

• Specific behavioral results
• Reduced screen time
• Uninterrupted or error-free operation

To the fullest extent permitted by law, all implied warranties are disclaimed.

8. Limitation of Liability

To the maximum extent permitted by law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the App.
• Our total liability for any claim arising from or related to the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless Uncle and its owner from any claims, damages, losses, liabilities, or expenses (including legal fees) arising from:

• Your misuse of the App
• Your violation of these Terms
• Your sharing or distribution of audio content
• Your violation of applicable laws

10. Termination

We may suspend or terminate access to the App if you violate these Terms.

You may stop using the App at any time by deleting it and canceling your subscription.

11. Dispute Resolution & Arbitration

Any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration on an individual basis.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

Arbitration shall be conducted in the State of Arizona, unless otherwise required by law.

12. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.

Apple Notice

This agreement is in addition to the Apple Standard End User License Agreement (EULA), which governs apps distributed through the App Store.
